Ernest Saunders, ousted Guinness PLC chairman and chief executive, was charged Thursday with attempting to pervert justice and with destroying and falsifying documents, after spending the night in jail. Mr. Saunders, 51, was charged by Scotland Yard early Thursday after being arrested late Wednesday by two fraud squad detectives at his lawyer's London office.He was charged with three counts covering the period from Dec. 1, 1986, to Jan. 13, 1987, Scotland Yard said. He faced one charge of attempting to pervert the course of justice, a violation of common law, and two charges of destroying and falsifying documents, a violation of the 1985 Companies Act, it said. Guinness, a huge brewer, is being investigated by the Department of Trade and Industry in connection with its takeover of Distillers Co. for 2.6 billion, then worth about $4.4 billion, a year ago. The company has admitted arranging for the repurchase of its stock, apparently to boost its price and make its cash-and-stock offer for Distillers more attractive than a rival bid. British law generally prohibits companies from repurchasing their stock without shareholder approval and from inducing investors to buy their stock. Mr. Saunders was fired as chairman and chief executive in January for his role in the scandal, which first broke in early December. Last month, Mr. Saunders denied allegations by a former aide that he had ordered files, appointment diaries and correspondence shredded in December after the Department of Trade and Industry began its investigation. Mr. Saunders, in a statement read in civil court at the time by his lawyer, Philip Heslop, said the allegations were "completely untrue." The aide, Margaret McGrath, made the allegations in a separate statement read in court a few days earlier. That court was hearing litigation begun by Guinness, which has been seeking to recover 25 million, about $42 million at current exchange rates, that apparently was used in the stock manipulation scheme. In April, Guinness announced that it had an extraordinary charge of 125 million last year stemming from the scandal and from its investment in a fund run by Wall Street arbitrageur Ivan Boesky. Guinness revealed in December that it had invested $100 million in Mr. Boesky's fund. Mr. Boesky, who speculated in Guinness and Distillers stock during the takeover bid, has paid a $100 million penalty in the United States and has pleaded guilty to a charge he violated federal securities laws. The series of disclosures regarding Guinness over the past several months has rocked the company and raised concerns in the City, London's financial district, over whether securities regulation in this country is adequate. Mr. Saunders remains a Guinness director but is expected to be removed at the company's annual shareholder meeting, which is scheduled for May 27.

These included three mainline and three feeder services that better connected China and the West Coast of South America utilizing Cosco’s hub port at Chancay, Peru, plus new routes connecting Southeast and South Asia with its Yangpu hub port following the launch of the Hainan free trade zone in southwest China. The focus on emerging trades helped drive double-digit growth in revenue and liftings from those regions compared with more modest results from trans-Pacific, Asia-Europe and Asia-Mediterranean services. Group figures, which comprise Cosco Shipping Lines and its Hong Kong-headquartered affiliate OOCL, show overall net profit increased 4% to $2.5 billion in the first half, while revenues rose 7% to $15 billion. That included an $819 million revenue contribution from Cosco Shipping Ports that was 15% higher than the first six months of 2024. Total throughput at the group’s domestic and international terminals increased 6% to 74 million TEUs. Reflecting the lackluster performance on the trans-Pacific, revenues on that trade edged up 1% to almost $4 billion in the first six months, while liftings were up 5% to 2.4 million TEUs. Cosco confirmed it has a vessel order backlog totaling 910,000 TEUs, including 42 methanol dual-fuel powered vessels with a total capacity of 780,000 TEUs. <div class="phx-topic">The International Longshoremen’s Association (ILA) is suing the Virginia Port Authority (VPA) and its chief executive, alleging they are using their control of the port’s terminal employer to violate the union’s master contract by forcing new rail crane technology on longshore workers. The lawsuit, filed Tuesday in federal court in Virginia, says the VPA and Chief Executive Stephen Edwards leveraged Virginia International Terminals (VIT) — the port’s separate legal entity that handles daily operations and directly employs longshore workers — to implement new technology at the port without going through the process required by the master contract. The suit, which further alleges the port authority sought to influence contract talks held earlier this year and in 2024 even though it was not a party to the talks, seeks to bar the VPA and Edwards from interfering in the contractual relationship between the union and VIT. “VPA and Edwards are aware of the terms and conditions of the master contract, specifically as they relate to the specific processes, procedures and assurances for implementing new technology, as well as the workforce protections guaranteed to ILA labor,” the lawsuit reads. “Yet, despite their knowledge of the terms and conditions of the master contract, VPA and Edwards have knowingly and intentionally interfered with the contract between VIT and ILA by causing VIT to violate that contract,” the suit adds. Under the ILA master contract ratified this past March, any new technology implemented by ports along the East and Gulf coasts must be vetted by a new technology committee comprised of the union and maritime employers to determine staffing levels for the new equipment, training and pay rates. The local union must also be notified so it can negotiate with employers about the new technology. However, the ILA alleges that VIT did not follow this process. Instead, “VIT said that the cranes had been purchased by VPA, not VIT.” VIT said that because VPA is not a party to the master contract, it did not have to inform the union about the new technology, the suit claims. The ILA said it only undertook the lawsuit after filing multiple grievances under the master contract. “Thus, VPA is using its authority to frustrate the collective bargaining process and interfere with the master contract relationship between ILA and VIT,” the lawsuit reads. The analysis, released Friday, examines the year-over-year shifts in global port congestion metrics in the second quarter, including number of calls, average call size, arrival process time, berth hours, port moves per hour and container dwell times. <h3>Global congestion hurdles </h3>Congestion hurdles in Northern Europe and the Mediterranean include efficiency declines and increased average port hours, or hours spent between arrival or anchorage until vessel departure. Congestion at European ports has been a growing problem for shippers, as the disparity between available capacity and demand <a href="https://www.joc.com/article/underinvestment-exposes-european-ports-to-systematic-bottlenecks-6062033">leaves deep-sea container terminals facing the potential of years-long bottlenecks</a>. Meanwhile, Mediterranean ports faced decreased productivity and increased average port hours.
