
ABF Freight System is taking its legal challenge against concession agreements negotiated by YRC Worldwide and the Teamsters to the U.S. Court of Appeals.
The less-than-truckload carrier filed an appeal of the Dec. 20 district court decision dismissing its case against its competitor with the appellate court in St. Louis.
"ABF respectfully disagrees with the court's decision last month," the company said in a statement. "Therefore, we have chosen to exercise our right to file an appeal."
It was ABF's first statement since U.S. District Judge Susan Webber Wright ruled after a hearing that ABF did not have jurisdiction to sue over the agreements.
The Arkansas Best subsidiary has argued the separate concession agreements with the Teamsters leaves YRC with a sharp cost advantage in the marketplace.
