Appellate Court to Expedite ABF-YRC Lawsuit

ABF Freight System's lawsuit challenging Teamster wage and pension concessions at YRC Worldwide is on a fast track toward a hearing in a federal appeals court.

The appellate court in St. Louis, Mo., granted YRC's request for expedited review, and a hearing will be held in April, the Kansas City Business Journal reports.

A U.S. District Court judge in Arkansas dismissed the lawsuit in December, deciding ABF didn't have the jurisdiction to sue its trucking rival and the union.

ABF argues three concession agreements YRC negotiated with the Teamsters violate the National Master Freight Agreement, and claims it is covered by the contract.

YRC and the Teamsters claim ABF is covered by a separate labor agreement, and has no standing to intervene in any negotiations between the union and YRC.
