The ability of NVOCCs to operate freely in the commercial marketplace will be significantly expanded as of Jan. 19, 2005, when the FMC's final regulations permitting "NVOCC Service Arrangements", or NSAs take effect. The new FMC rule Will for the first time grant NVOs the ability to sign confidential ocean shipping agreements with proprietary shippers. This ruling will significantly change the regulatory landscape for NVOs, giving them the commercial flexibility that has been lacking since enactment of the 1998 Ocean Shipping Reform Act. It will also have a significant impact on shipper associations, carriers and shippers.
