Federal Maritime Commissioner Rebecca F. Dye, and Mario Cordero, Long Beach harbor commissioner and FMC appointee, were among more than 100 unconfirmed administration appointments that were returned to the president as the Senate adjourned on Wednesday.
Also included on the list were Eric Hirschhorn, Commerce Department under secretary for export administration, Customs Commissioner Alan Bersin, and Ann D. Begeman, who was nominated to the Surface Transportation Board.
According to Senate rules, a nomination that the Senate rejects or does not act on are returned to the president when Congress adjourns for the last time. Nominees must be re-nominated and go through the confirmation process in the next congressional term. The president has the option of making recess appointments, as he did with 15 key executives last March.
Hirschhorn and Bersin were among the recess nominees and may continue to serve without confirmation until December 2011.
President Obama on Sept. 20 nominated Dye to a third term on the FMC, and Cordero to his first. Dye will likely keep her seat until confirmed or replaced by the president. Commissioner Joseph E. Brennan continues to serve on the commission although his term expired in June 2008.
