FMC Opens Investigation of Chinese NVO

Sinicway accused of falsely describing cargo to get lower rates

The Federal Maritime Commission on Tuesday announced the investigation of a Chinese non-vessel-operating common carrier for violations of the Shipping Act.

The FMC alleges that Sinicway International Logistics got lower rates from ocean carriers by falsely describing garments and other cargo as household goods. The company also allegedly offered customers rates below its published tariff.

Sinicway’s case was referred to the FMC administrative law division, with provision for a public hearing at a future date. The judge should render an initial decision by Aug. 22, 2011, with a final decision by the commission by Dec. 20, 2011.
